See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On October 2, 2023, Elise Lambert requested: [1.] All records containing or reflecting any lists of covert audio recording technology that has been approved by the Division Commanders of the Division of Investigative Services and the Division of Homeland Security. [2.] All records containing or reflecting any members’ requests for approval to use covert audio recording technology that is not on the list approved by a Division Commander. [3.] All records containing or reflecting any list of members who have successfully completed any training on a covert recording technology as required by their respective Division Commander, and are authorized to use covert recording technology in any capacity. [4.] All records containing or reflecting a log of any issued covert recording licenses, accounts, and/or equipment[.] Claiming to not yet have received responsive records, Elise Lambert petitioned this office and this appeal, SPR23/2599, was opened as a result. Despite being notified of the opening of this appeal, it remains unclear whether the Department has provided a response. Accordingly, the Department is ordered to provide Elise Lambert with a response to her request, provided in a manner consistent with this order, the Public Records Law and its Regulations within ten (10) business days. A copy of any such response must be provided to this office.
