Assistant City Solicitor Law Department City of Worcester 455 Main Street, Room 301 Worcester, MA 01608 Dear Attorney Thompson: I have received the petition of Attorney James Hasson, of The Committee for Public Counsel Services, appealing the nonresponse of the City of Worcester (City) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On September 27, 2023, Attorney Hasson requested “… [an identified police officer’s] body worn camera footage for [a specified incident]. I am also requesting the body worn camera footage for any other officer present[.]” Claiming to not yet have received a response, Attorney Hasson petitioned this office and this appeal, SPR23/2604, was opened as a result. Subsequently, I learned that the City intends on providing a written response to Attorney Hasson. Accordingly, the City is ordered to provide Attorney Hasson with a response in accordance with the Public Records Law, its Regulations and this order within ten business days. It is preferable to send an electronic copy of the response to this office at pre@sec.state.ma.us. Attorney Hasson may appeal the substantive nature of the City’s response within ninety days.
