The Commonwealth of Massachusetts William Francis Galvin, Secretary of the Commonwealth Public Records Division Manza Arthur Supervisor of Records November 17, 2023 SPR23/2650 Allison Mondello Public Records Manager Department of State Police 470 Worcester Road Framingham, MA 01702 Dear Ms. Mondello: I have received the petition of Michael J. Heineman, Esq., of HBMH Law, appealing the response of the Department of State Police (Department) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On August 3, 2023, Attorney Heineman requested “all records relating to the interactions between Massachusetts State Troopers and [an identified individual] on August 6, 2021.” On October 19, 2023, the Department provided responsive records but identified four records that it was withholding. The Department stated that it was withholding the records pursuant to Exemptions (a), (c), and (f) of the Public Records Law. G.L. c. 4, § 7(26)(a), (c), (f). Unsatisfied with the Department’s response, Attorney Heineman petitioned this office and this appeal, SPR23/2650, was opened as a result. Subsequently, I learned that the Department responded to Attorney Heineman’s request with a further response sent on November 7, 2023. Where this appeal was opened as a result of the Department’s October 19th response, I will now consider this administrative appeal closed. Attorney Heineman may appeal the substantive nature of the Department’s November 7th response within ninety days. See 950 C.M.R. 32.08(1). Sincerely, Manza Arthur Supervisor of Records cc: Michael J.
