Senior Counsel, Public Records and Records Management Office of General Counsel Massachusetts Department of Transportation 10 Park Plaza, Suite 3910 Boston, MA 02116 Dear Attorney Shorey: I have received the petition of Laura Crimaldi, of the Boston Globe, appealing the response of the Massachusetts Bay Transportation Authority (MBTA) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On September 18, 2023, Ms. Crimaldi requested, “... right of way worker and/or crew positions for Aug. 20, 2023 to Sept. 2, 2023, including the following fields”: [1.] Level of protection granted for each instance of worker/crews accessing the right of way; [2.] The date and time of worker/crew access to the right of way; [3.] The number of workers/crews entering the right of way for each date/time; [4.] The location of the workers/crews on the right of way for each instance; [5.] Descriptions of the reasons for worker/crews accessing the right of way for each instance. The MBTA responded on October 6, 2023. Unsatisfied with the response, Ms. Crimaldi petitioned this office and this appeal, SPR23/2675, was opened as a result. It is my understanding that the MBTA intends on providing a further response to Ms. Crimaldi to address the records request. Accordingly, the MBTA is ordered to provide Ms. Crimaldi with said response in a manner consistent with the Public Records Law and its Regulations within 10 business days. A copy of any such response must be provided to this office. It is preferable to send an electronic copy of the response to this office at pre@sec.state.ma.us. Ms. Crimaldi may appeal the substantive nature of the MBTA’s response within ninety days. See 950 C.M.R. 32.08(1).
