See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On September 22, 2023, Ms. Crimaldi requested the following records: [1.] Records submitted to the Federal Transit Administration and Department of Public utilities explaining delays in reporting near-miss incidents to the MBTA Safety Department and Department of Public Utilities since Aug.1, 2023 in accordance with the FTA’s immediate action letter of Sept. 14, 2023; [2.] Reports, memos, records of process/procedures, implementation, and data from the “worker ahead flagging pilot” program on the Green Line between Hynes and Park Street stations. The MBTA provided a response on October 23, 2023. Unsatisfied with the response, Ms. Crimaldi petitioned this office and this appeal, SPR23/2680, was opened as a result. Based on an email sent to this office on November 17, 2023, I learned that the MBTA intends to provide a further response to Ms. Crimaldi. Accordingly, the MBTA is ordered to provide Ms. Crimaldi with said response, in a manner consistent with this order, the Public Records Law and its Regulations within ten (10) business days. A copy of any such response must be provided to this office. It is preferable to send an electronic copy of the response to this office at pre@sec.state.ma.us. Ms. Crimaldi may appeal the substantive nature of the Department’s response within ninety (90) days. See 950 C.M.R. 32.08(1).
