See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On September 15, 2023, Ms. Crimaldi requested the following records: [1.] State reportable incident reports and/or memos for near-misses on 8/10/2023 at North Quincy station, on 8/28/2023 between Brookline Hills and Brookline Village; and on Sept. 6 on the Longfellow Bridge; [2.] Safety flash 23-09, safety flash 23-11, safety flash 23-12; ]3.] Special Order 167; [4.] Memo from Operations Control Center senior director to the OCC staff about logging row access into the OCC logging system; [5.] Audit of the OCC logging system, night order tracking; [6.] Work Management Key Performance Indicator dashboards developed by Engineering and Maintenance for inspection and preventative maintenance, track conditions, and speed conditions. The MBTA responded on October 20, 2023. Unsatisfied with the response, Ms. Crimaldi petitioned this office and this appeal, SPR23/2681, was opened as a result. It is my understanding that the MBTA intends on providing a further response to Ms. Crimaldi to address her records request. Accordingly, the MBTA is ordered to provide Ms. Crimaldi with said response in a manner consistent with the Public Records Law and its Regulations within 10 business days. A copy of any such response must be provided to this office.
