Assistant General Counsel Boston Public Health Commission 1010 Massachusetts Avenue, 6th Floor Boston, MA 02118 Dear Attorney Pasternack: I have received the petition of Brian McCarter appealing the response of the Boston Public Health Commission (Commission) to a request for public records. See G. L. c. 66 § 10A; see also 950 C.M.R. 32.08(1). On October 25, 2023, Mr. McCarter requested “all emails, records of any communication, inspections, reports or anything you have related to [a specificied address] in the last three months” as well as “all permit applications or requests of any kind in the last three months, especially ones that have not been approved or are in the process of being requested.” The Commission provided a response on November 8, 2023. Unsatisfied with the response, Mr. McCarter petitioned this office and this appeal, SPR23/2711, was opened as a result. Subsequently, I learned that the Commission provided Mr. McCarter with a further response dated November 15, 2023. Where this appeal was opened as a result of the Commission’s November 8th response, I will now consider this administrative appeal closed. Mr. McCarter may appeal the substantive nature of the Commission’s November 15th response within ninety (90) days. See 950 C.M.R. 32.08(1).
