Deputy General Counsel Department of Early Education and Care 50 Milk Street, 14th Floor Boston, MA 02109-5002 Dear Attorney Orthman, I have received the petition of Attorney Lucas Newbill appealing the nonresponse of the Department of Early Education and Care (Department) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On October 23, 2023, Attorney Newbill requested “…copies of all documents, communications, and electronically-stored information (ESI) concerning [an identified individual]…includ[ing] any communication regarding [an identified individual] with persons outside the EEC.” Claiming to not yet have received a response, Attorney Newbill petitioned this office and this appeal, SPR23/2716, was opened as a result. Subsequently, I learned that the Department intends on providing a written response to Attorney Newbill. Accordingly, the Department is ordered to provide Attorney Newbill with a response in accordance with the Public Records Law, its Regulations and this order within ten business days. A copy of any such response must be provided to this office. It is preferable to send an electronic copy of the response to this office at pre@sec.state.ma.us.
