Assistant General Counsel Board of Registration in Medicine 200 Harvard Mill Square, Suite 330 Wakefield, MA 01880 Dear Attorney Douglas: I have received the petitions of Justice Ainooson appealing the nonresponses of the Board of Registration in Medicine (Board) to requests for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). In separate requests on August 23, 2023 and August 24, 2023, Mr. Ainooson requested the physician profiles for seven (7) identified individuals. Claiming to not yet have received responsive records, Mr. Ainooson petitioned this office and the following appeals, SPR23/2733 and SPR23/2734, were opened as a result. Based upon a conversation between a Public Records Division staff member and the Board, it is my understanding that the Board intends on providing a response to Mr. Ainooson. Accordingly, the Board is ordered to provide Mr. Ainooson with said response in a manner consistent with this order, the Public Records Law, and its Regulations within 10 business days. A copy of any such response must be provided to this office. It is preferable to send an electronic copy of the response to this office at pre@sec.state.ma.us. Mr. Ainooson may appeal the substantive nature of the Board’s response within ninety days. See 950 C.M.R. 32.08(1).
