The Commonwealth of Massachusetts William Francis Galvin, Secretary of the Commonwealth Public Records Division Manza Arthur Supervisor of Records November 27, 2023 SPR23/2744 Officer Mark Panagiotakos Records Access Officer Lawrence Police Department 90 Lowell Street Lawrence, MA 01840 Dear Officer Panagiotakos: I have received the petition of Randy Arias appealing the nonresponse of the Lawrence Police Department (Department) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On September 26, 2023, Mr. Arias requested “... any and all documents pertaining to [an identified] Detective as to whether he was/is the subject of any external, internal, informal, formal, criminal or civil investigation regarding police misconduct relating to his personal or professional duties.” Claiming to not yet have received responsive records, Mr. Arias petitioned this office and this appeal, SPR23/2744, was opened as a result. Subsequently, I learned that the Department provided Mr. Arias with a response dated November 13, 2023. Where this appeal was opened as a result of the Department’s lack of a written response, I will now consider this administrative appeal closed. Mr. Arias may appeal the substantive nature of the Department’s November 13th response within ninety (90) days. See 950 C.M.R. 32.08(1).
