Director of Public Records City of Boston One City Hall Square Boston, MA 02201 Dear Attorney Williams: I have received the petition of Colman Herman appealing the nonresponse of the Boston Public Schools (School) to a request for public records. G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On October 31, 2023, Mr. Herman requested “…a copy of the Annual Equity Report for 2022-2023.” Claiming to not yet have received responsive records, Mr. Herman petitioned this office and this appeal, SPR23/2753, was opened as a result. Subsequently, I learned that the School provided Mr. Herman with a response dated November 15, 2023. Where this appeal was opened as a result of the School’s lack of a written response, I will now consider this administrative appeal closed. Mr. Herman may appeal the substantive nature of the School’s response within ninety (90) days. See 950 C.M.R. 32.08(1).
