Records Access Officer Office of the General Counsel Department of Conservation and Recreation 251 Causeway Street Boston, MA 02114 Dear Attorney Tencellent: I have received the petition of Alan Moore, of MuckRock News, appealing the response of the Department of Conservation and Recreation (Department) to a request for public records. See G. L. c. 66 § 10A; see also 950 C.M.R. 32.08(1). On August 20, 2023, Mr. Moore requested, “[t]he (75% or latest) Design Documents for the Mystic River bicycle/pedestrian bridge.” On September 8, 2023, the Department responded and indicated that it was withholding responsive records pursuant to Exemption (n) of the Public Records Law. G. L. c. 4, § 7(26)(n) Unsatisfied with the Department’s response, Mr. Moore petitioned this office and this appeal, SPR23/2768, was opened as a result. Subsequently, I learned that the Department provided Mr. Moore with a further response on November 30, 2023. Where this appeal was opened as a result of the Department’s September 8th response, I will now consider this administrative appeal closed. Mr. Moore may appeal the substantive nature of the Department’s November 30th response within ninety days. See 950 C.M.R. 32.08(1).
