Assistant General Counsel Massachusetts Bay Transportation Authority 10 Park Plaza, Suite 7760 Boston, MA 02116 Dear Attorney Ciollo: I have received the petition of Sean Murphy, of the Boston Globe, appealing the nonresponse of the Massachusetts Bay Transportation Authority (MBTA) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On October 27, 2023, Mr. Murphy requested “…a copy of the construction punch list on the GLX as of December 12, 2022, as of June 1, 2023, and as of October 1, 2023. This request is for the lists, not for any attachments to the lists.” Claiming to not yet have received responsive records, Mr. Murphy petitioned this office and this appeal, SPR23/2778, was opened as a result. Subsequently, I learned that the MBTA provided a response to Mr. Murphy on November 20, 2023. Where this appeal was opened as a result of the MBTA’s lack of a written response, I will now consider this administrative appeal closed. It is my understanding that Mr. Murphy has appealed the MBTA’s November 20th response, resulting in a new appeal which is currently opened as SPR23/2852.
