Bouchard City Clerk City of Fall River One Government Center Fall River, MA 02772 Dear Ms. Bouchard: I have received the petition CJ Ferry appealing the response of the City of Fall River (City) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On October 25, 2023, CJ Ferry requested “the . . . documents that have been identified in the Herald News request and the court order including but not limited to, the . . . Employe [sic] file, the investigative report that was sought by the City of Fall River, a copy of [the] separation agreement and any and all other documents referenced in the judge’s order.” On October 24, 2023, the City responded and acknowledged the request. Unsatisfied with the City’s response, CJ Ferry petitioned this office and this appeal, SPR23/2800, was opened as a result. On November 20, 2023, the City provided a further response, including responsive records in redacted form. CJ Ferry remained unsatisfied with the City’s response and requested that the City provide him the records without redactions. In a telephone conference with a City representative, the City stated that it intends on providing a further response to CJ Ferry. Accordingly, the City is ordered to provide CJ Ferry with said response in a manner consistent with the Public Records Law and its Regulations within ten (10) business days. A copy of any such response must be provided to this office. It is preferable to send an electronic copy of the response to this office at pre@sec.state.ma.us. CJ Ferry may appeal the substantive nature of the City’s response within ninety days. See 950 C.M.R. 32.08(1).
