Bouchard City Clerk City of Fall River One Government Center Fall River, MA 02772 Dear Ms. Bouchard: I have received the petition CJ Ferry appealing the nonresponse of the City of Fall River (City) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On October 25, 2023, CJ Ferry requested “copies of the arbitrators award for the Fall River Fire Department. If no such document exists, please provide the settlement that the Fire Union IAFF L‐1314 announced on Tuesday night.” Claiming to not yet have received responsive records, CJ Ferry petitioned this office and this appeal SPR23/2763 was opened as a result. Subsequently, I learned that the City provided Mr. Ferry with a response dated November 21, 2023. Where this appeal was opened as a result of the City’s lack of a written response, I will now consider this administrative appeal closed. Mr. Ferry may appeal the substantive nature of the City’s response within ninety (90) days. See 950 C.M.R. 32.08(1).
