The Commonwealth of Massachusetts William Francis Galvin, Secretary of the Commonwealth Public Records Division Manza Arthur Supervisor of Records December 7, 2023 SPR23/2831 Derek Sullivan Town Administrator Town of Wareham 54 Marion Road Wareham, MA 02571 Dear Mr. Sullivan: I have received the petition of Paul K. Healey, Esq., of Amabile & Burkly, PC, appealing the nonresponse of the Town of Wareham (Town) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On October 23, 2023, Attorney Healey requested “[t]he 12 pages from Allied Design dated 8/21/18 and 2 pages from Lockwood Architects dated 9/1/18 referenced on Building Permit C-19-265 issued on 04-Oct-2018 by the Town of Wareham...” Claiming to not yet have received responsive records, Attorney Healey petitioned this office and this appeal, SPR23/2831, was opened as a result. Subsequently, I learned that the Town provided Attorney Healey with a response dated November 27, 2023. Where this appeal was opened as a result of the Town’s lack of a written response, I will now consider this administrative appeal closed. Attorney Healey may appeal the substantive nature of the Town’s November 27th response within ninety (90) days. See 950 C.M.R. 32.08(1). Sincerely, Manza Arthur Supervisor of Records cc: Paul K. Healey, Esq. One Ashburton Place, Room 1719, Boston, Massachusetts 02108 • (617) 727-2832• Fax: (617) 727-5914 sec.state.ma.us/pre • pre@sec.state.ma.us
