McMahon III, Esq., of the Law Offices of James R. McMahon, III, appealing the nonresponse of the Canton Police Department (Department) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On October 16, 2023, Attorney McMahon requested the following records with regard to [an identified individual] and decision of the Department to suspend the individual’s License to Carry (LTC): [1.] Application for License to Carry Firearms originally submitted to the Canton Police Chief resulting in the original issuance of the LTC... [2.] [The] [o]riginal letter submitted ... informing him that his original application for LTC was approved, (or words to that effect); [3.] All other documentation, since the original LTC approval, which contains information utilized individually, and/or collectively, in support of Suspension Decision of June 1, 2023. Claiming to not yet have received responsive records, Attorney McMahon petitioned this office and this appeal, SPR23/2844, was opened as a result. Subsequently, I learned that the Department provided Attorney McMahon with a response dated November 27, 2023. Where this appeal was opened as a result of the Department’s lack of a written response, I will now consider this administrative appeal closed. Attorney McMahon may appeal the substantive nature of the Department’s November 27th response within ninety (90) days. See 950 C.M.R. 32.08(1).
