The Commonwealth of Massachusetts William Francis Galvin, Secretary of the Commonwealth Public Records Division Manza Arthur Supervisor of Records December 13, 2023 SPR23/2871 Helena Rafferty Chief of Police Canton Police Department 1492 Washington Street Canton, MA 02021 Dear Chief Rafferty: I have received the petition of Deanna Corby appealing the response of the Canton Police Department (Department) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On November 6, 2023, Ms. Corby requested the following records: [1.] … all call log records pertaining to calls made to the Canton Police Department on November 5th, 2023, specifically related to the response of peaceful protesters on Washington Street in Canton from 12PM-3:00PM…. [2.] [A]ll video recordings of the peaceful protestors.… [3.] [R]ecordings of dispatch call logs and or computer aided dispatch logs.… [4.] [R]ecording of radio transmissions during that time period related to that area. Prior Appeal The requested records were the subject of a prior appeal. See SPR23/2840 Determination of the Supervisor of Records (November 28, 2023). In my November 28th determination, I learned that the Department provided a response to Ms. Corby on November 8, 2023, and closed the appeal. In the Department’s November 8th response, it indicated that it was withholding responsive records pursuant to Exemption (f) of the Public Records Law. G. L. c. 4, § 7(26)(f). Unsatisfied with the Department’s response, Ms. Corby petitioned this office and this appeal, SPR23/2871, was opened as a result. It is my understanding that the Department intends on providing a further response to Ms. Corby. A copy of any such response must be provided to this office. It is preferable to send an electronic copy of the response to this office at pre@sec.state.ma.us.
