The Commonwealth of Massachusetts William Francis Galvin, Secretary of the Commonwealth Public Records Division Manza Arthur Supervisor of Records December 13, 2023 SPR23/2889 Kate Silvia Director of Communications Department of Correction 50 Maple Street, Suite 3 Milford, MA 01757 Dear Ms. Silvia: I have received the petition of Anthony Barry appealing the nonresponse of the Department of Correction (Department) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On November 1, 2023, Mr. Barry requested the following records: [1.] All requests to expend in excess of $1,000 from the Inmate Benefit Account per 103 DOC 476, for MCI Shirley Medium and MCI Norfolk from 2020 to the present. [2.] The monthly inmate benefit revenue reports for the last 36 months. [3.] The last six years of annual reports from the audit and compliance unit for MCI Shirley Medium and MCI-Norfolk. [4.] All Institutional Expenditure Request Forms for MCI Shirley Medium and MCI Shirley Medium, for expenditures< $1,000.00, from 2020 to the Present. Claiming to not yet have received responsive records, Mr. Barry petitioned this office and this appeal, SPR23/2889, was opened as a result. Despite being notified of the opening of this appeal, it remains unclear whether the Department has provided a response. Accordingly, the Department is ordered to provide Mr. Barry with a response to his request, provided in a manner consistent with this order, the Public Records Law and its Regulations within ten (10) business days. A copy of any such response must be provided to this office. It is preferable to send an electronic copy of the response to this office at pre@sec.state.ma.us. Mr. Barry may appeal the substantive nature of the Department’s response within ninety (90) days. See 950 C.M.R. 32.08(1).
