Legal Counsel Executive Office of Public Safety and Security 1 Ashburton Place, Suite 2133 Boston, MA 02108 Dear Attorney Mullaney Poncia: I have received the petition of Sydney Topf appealing the nonresponse of the Executive Office of Public Safety and Security (Office) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On November 7, 2023, Ms. Topf requested the following records: [1.] Any and all communications and/or records that refer to the number and information of prisoner and correction officers overdose cases at MCI-Norfolk in 2019, 2020, 2021 and 2022. [2.] Any and all communications and/or records, including disciplinary reports, conducted by the professional standards unit or other departments about drug overdoses or drug usage by corrections officers at MCI-Norfolk. Claiming to not yet have received responsive records, Ms. Topf petitioned this office and this appeal, SPR23/2890, was opened as a result. Subsequently, I learned that the Office provided Ms. Topf with a response dated December 12, 2023. Where this appeal was opened as a result of the Office’s lack of a written response, I will now consider this administrative appeal closed. Ms. Topf may appeal the substantive nature of the Office’s response within ninety (90) days. See 950 C.M.R. 32.08(1).
