Legal Counsel Executive Office of Public Safety and Security 1 Ashburton Place, Suite 2133 Boston, MA 02108 Dear Attorney Mullaney Poncia: I have received the petition of Sydney Topf appealing the nonresponse of the Executive Office of Public Safety and Security (Office) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On November 7, 2023, Mr. Topf requested the following records: [1.] A list of all the employees at MCI-Norfolk and their positions from 2019, 2020, 2021 and 2022. [2.] Any and all communications and/or records that refer to the amount of years each correctional officer worked at MCI-Norfolk who worked in 2019, 2020, 2021 and 2022. Claiming to not yet have received responsive records, Ms. Topf petitioned this office and this appeal, SPR23/2891, was opened as a result. Despite being notified of the opening of this appeal, it remains unclear whether the Office has provided a response. Accordingly, the Office is ordered to provide Ms. Topf with a response to her request, provided in a manner consistent with this order, the Public Records Law and its Regulations within ten (10) business days. A copy of any such response must be provided to this office. It is preferable to send an electronic copy of the response to this office at pre@sec.state.ma.us. Ms. Topf may appeal the substantive nature of the Office’s response within ninety (90) days. See 950 C.M.R. 32.08(1).
