Herman appealing the response of the Cannabis Control Commission (Commission) to a request for public records. See G. L. c. 66 § 10A; see also 950 C.M.R. 32.08(1). On November 20, 2023, Mr. Herman requested “any and all expense records related to any and all out-of-state trips” taken by four specific Commission staff members. Previous appeal This request was the subject of a previous appeal. See SPR23/2757 Determination of the Supervisor of Records (November 28, 2023). In the November 28th determination, I closed the appeal based upon the understanding that the Commission intended on providing a further response. The Commission provided a response on November 30, 2023. Unsatisfied with the response, Mr. Herman petitioned this office and this appeal, SPR23/2896, was opened as a result. Subsequently, I learned that the Commission provided Mr. Herman with a further response dated December 13, 2023. Where this appeal was opened as a result of the Commission’s November 30th response, I will now consider this administrative appeal closed. Mr. Herman may appeal the substantive nature of the Commission’s December 13th response within ninety (90) days. See 950 C.M.R. 32.08(1).
