See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On November 15, 2023, Mr. Falco requested the following records: Any and all [i]nsurance and/or liability ‘Coverage Determination Letter’ and/or ‘Reservation of Rights letters’ from the Town of Rockland Municipal insurance carrier or written from Glatfelter Claims Management, National Union and its affiliated companies or from any and all of the Town of Rockland Liability insurance carriers from the period of 07/01/20 to the current period. Claiming to not yet have received a response, Mr. Falco petitioned this office and this appeal, SPR23/2902 was opened as a result. Subsequently, I learned the Town provided a response to Mr. Falco on November 30, 2023. Where this appeal was opened as a result of the Town’s lack of a written response, I will now consider this administrative appeal closed. Mr. Falco may appeal the substantive nature of the Town’s response within 90 days. See 950 C.M.R. 32.08(1).
