Morgan, appealing the response of the Town of Ashland (Town) to his request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On November 16 2023, Mr. Morgan requested: all related documents, including but not limited to interview notes, contact logs, transcription, reports, drawings, calculations or other forms of documentation that relate to and support the proposed survey line the town is claiming against me. (see 250CMR and other authority regarding what is required of the surveyor regarding documentation of the process and provide it. If you do not have it please ensure that you have a surveyor that is working to standards. Email or electronic is preferred. On November 30, 2023, the Town responded and indicated that it would require additional time to provide a response to Mr. Morgan. Unsatisfied with the Town’s response, Mr. Morgan petitioned this office and this appeal, SPR23/2920, was opened as a result. It is my understanding that the Town intends on providing a further response to Mr. Morgan. Accordingly, the Town is ordered to provide Mr. Morgan with said response in a manner consistent with the Public Records Law and its Regulations within ten (10) business days. A copy of any such response must be provided to this office. It is preferable to send an electronic copy of the response to this office at pre@sec.state.ma.us. Mr. Morgan may appeal the substantive nature of the Town’s response within ninety days. See 950 C.M.R. 32.08(1).
