General Counsel Fall River Housing Authority 85 Morgan Street Fall River, MA 02722 Dear Attorney Sousa: I have received the petition of Todd Wallack, of WBUR, appealing the nonresponse of the Fall River Housing Authority (Authority) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On October 30, 2023, Mr. Wallack requested the following records: [1.] Any correspondence with DHCD since 2019 regarding fines for failing to obtain waivers for vacant units. [2.] Minutes of any housing authority meetings where fines were discussed. This request was the subject of a previous appeal. See SPR23/2887 Determination of the Supervisor of Records (December 4, 2023). In my December 4th determination, I closed SPR23/2887 in light of the Authority providing Mr. Wallack with a written response on November 30, 2023. Unsatisfied with the Authority’s response, Mr. Wallack further appealed, and this case was opened as a result. Subsequent to the opening of this appeal, based on a telephone conversation between this office and the Authority on December 5, 2023, I understand that the Authority intends to provide a supplemental response to Mr. Wallack. Accordingly, said response must be provided in a manner consistent with the Public Records Law and its regulations within ten business days. It is preferable to send an electronic copy of the response to this office at pre@sec.state.ma.us. If issues remain unresolved, Mr. Wallack may appeal the substantive nature of the Authority’s supplemental response within ninety days. See 950 C.M.R. 32.08(1).
