City Solicitor City of Everett 484 Broadway Everett, MA 02149 Dear Attorney Mejia: I have received the petition of Joan P. Beckta appealing the response of the City of Everett (City) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On July 6, 2023, Ms. Beckta requested, “…documentation of the fair market value of … Church St. ...” Prior Appeal The requested records were the subject of a prior appeal. See SPR23/2295 Determination of the Supervisor of Records (October 11, 2023). In my October 11th determination, I found that the City did not meet its burden of specificity to withhold responsive records pursuant to the attorney-client privilege and Exemptions (a) and (i) of the Public Records Law. On November 30, 2023, the City provided a further response. Unsatisfied with the City’s response, Ms. Beckta petitioned this office and this appeal, SPR23/2932, was opened as a result. Subsequently, I learned that the City provided a further response to Ms. Beckta on December 12, 2023. Where this appeal was opened as a result of the City’s November 30th response, I will now consider this administrative appeal closed. Ms. Beckta may appeal the substantive nature of the City’s December 12th response within ninety days. See 950 C.M.R. 32.08(1).
