Lavallee, Esq., of Raipher P.C., appealing the nonresponse of the Massachusetts Department of State Police (Department) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On November 16, 2023, Attorney Lavallee requested the following records: [1.] A copy (audio and video) of [an identified] Trooper’s body worn camera footage from a motor vehicle stop on or about October 8, 2023, on Rt. 90 in Blandford, MA, concerning all interactions with [an identified individual]; [2.] A copy (audio and video) of [an identified] Trooper’s cruiser mounted camera footage from a motor vehicle stop on or about October 8, 2023, on Rt. 90 in Blandford, MA, concerning all interactions with [an identified individual]; [3.] A copy (audio and video) of [an identified] lieutenant’s body worn camera footage from all interactions with [an identified individual] at the B-8 Westfield State Police [B]arracks, on or about October 8, 2023; [4.] A copy (audio and video) of [an identified] Trooper’s body worn camera footage from a motor vehicle stop on or about October 8, 2023, on Rt. 90 in Blandford, MA, concerning all interactions with [an identified individual]; and [5.] Copies of all cruiser to cruiser communications between [three identified police officers] concerning the motor vehicle stop[,] seizure[,] and arrest of [an identified individual] on October 8, 2023, in Blandford & Westfield, Massachusetts. Allison Mondello SPR23/2946 Page 2 December 19, 2023 Claiming to not yet have received a response, Attorney Lavallee petitioned this office and this appeal, SPR23/2946, was opened as a result. Despite being notified of the opening of this appeal, it remains unclear whether the Department has provided a response. Accordingly, the Department is ordered to provide Attorney Lavallee with a response to her request, provided in a manner consistent with this order, the Public Records Law and its Regulations within ten (10) business days. A copy of any such response must be provided to this office. It is preferable to send an electronic copy of the response to this office at pre@sec.state.ma.us.
