Assistant General Counsel Records Access Officer Massachusetts Bay Transportation Authority 10 Park Plaza, Suite 7760 Boston, MA 02116 Dear Attorney Ciollo: I have received the petition of Laura Crimaldi, of the Boston Globe, appealing the response of the Massachusetts Bay Transportation Authority (MBTA) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On September 22, 2023, Ms. Crimaldi requested the following records: [1.] Records submitted to the Federal Transit Administration and Department of Public utilities explaining delays in reporting near-miss incidents to the MBTA Safety Department and Department of Public Utilities since Aug.1, 2023 in accordance with the FTA’s immediate action letter of Sept. 14, 2023; [2.] Reports, memos, records of process/procedures, implementation, and data from the “worker ahead flagging pilot” program on the Green Line between Hynes and Park Street stations. Prior Appeal This request was the subject of a prior appeal. See SPR23/2680 Determination of the Supervisor of Records (November 17, 2023). In my November 17th determination, it was my understanding that the MBTA intended to provide a subsequent response. The MBTA provided a response on December 13, 2023. Unsatisfied with the response, Ms. Crimaldi petitioned this office and this appeal, SPR23/2998, was opened as a result. Subsequently, I learned that the MBTA provided a further response on December 13, 2023. In an email correspondence to this office on December 14, 2023, Ms. Crimaldi indicated “[p]lease close the appeal. . .” Accordingly, I will consider this administrative appeal closed.
