The Commonwealth of Massachusetts William Francis Galvin, Secretary of the Commonwealth Public Records Division Manza Arthur Supervisor of Records January 3, 2024 SPR23/3041 Liza Landy Town Clerk/Records Access Officer Town of Rockland 242 Union Street Rockland, MA 02370 Dear Ms. Landy: I have received the petition of Christopher Falco appealing the response of the Town of Rockland (Town) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On November 15, 2023, Mr. Falco requested: Any and all [i]nsurance and/or liability “Coverage Determination Letter” and/or “Reservation of Rights letters” from the Town of Rockland Municipal insurance carrier or written from Glatfelter Claims Management, National Union and its affiliated companies or from any and all of the Town of Rockland Liability insurance carriers from the period of 07/01/20 to the current period. Prior Appeal The requested records were the subject of a prior appeal. See SPR23/2902 Determination of the Supervisor of Records (December 12, 2023). In my December 12th determination, I closed the appeal after I learned that the Town provided a further response to Mr. Falco on November 30, 2023, including a fee estimate. Objecting to the fees, Mr. Falco petitioned this office and this appeal, SPR23/3039, was opened as a result. It is my understanding that the Town intends on providing a further response to Mr. Falco. Accordingly, the Town is ordered to provide Mr. Falco with said response in a manner consistent with the Public Records Law and its Regulations within ten (10) business days. A copy of any such response must be provided to this office. It is preferable to send an electronic copy of the response to this office at pre@sec.state.ma.us. Mr. Falco may appeal the substantive nature of the Town’s response within ninety days. See 950 C.M.R. 32.08(1).
