Maslowski, CMC Town Clerk Town of Yarmouth 1146 Route 28 South Yarmouth, MA 02664 Dear Ms. Maslowski: I have received the petition of Norman Holcomb appealing the nonresponse of the Town of Yarmouth (Town) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On November 30, 2023, Mr. Holcomb requested the following records: [1.] Communications and documents in Town’s possession regarding the transfer of the Forest Road property to the Yarmouth Housing Authority since [my] April 27th letter to the Board of Selectmen…[;] [2.] The letters from Town attorneys or the State about the legality of the Town meeting votes in October 2011, April 2012 and April 2013[;] [3.] Copies of any communications or studies of water quality and flooding since 2013 about the Forest Road property and about any threats to Town wells in that area[.] Claiming to not yet have received responsive records, Mr. Holcomb petitioned this office and this appeal, SPR23/3042, was opened as a result. Subsequently, I learned that the Town provided Mr. Holcomb with a response dated December 29, 2023. Where this appeal was opened as a result of the Town’s lack of a written response, I will now consider this administrative appeal closed. Mr. Holcomb may appeal the substantive nature of the Town’s response within ninety (90) days. See 950 C.M.R. 32.08(1).
