Assistant General Counsel Board of Registration in Medicine 200 Harvard Mill Square, Suite 330 Wakefield, MA, 01880 Dear Attorney Douglas: I have received the petition of William McDonagh appealing the nonresponse of the Board of Registration in Medicine (Board) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On November 5, 2023, Mr. McDonagh requested the following records: [1.] A copy of any response from [an identified individual], with regards to a complaint made to the Board with regards to Docket # 22-428[;] [2.] A copy of the complaint registered with the date and time it was received by your department. [3.] A copy of all relevant information with regards to this case and all decisions made. Claiming to not yet have received responsive records, Mr. McDonagh petitioned this office and this appeal, SPR23/3077, was opened as a result. Subsequently, I learned that the Board intends on providing a response to Mr. McDonagh. Accordingly, The Board is ordered to provide Mr. McDonagh with said response in accordance with the Public Records Law, its Regulations and this order within ten business days. A copy of any such response must be provided to this office. It is preferable to send an electronic copy of the response to this office at pre@sec.state.ma.us. Mr. McDonagh may appeal the substantive nature of the Board’s response within ninety days. See 950 C.M.R. 32.08(1).
