The Commonwealth of Massachusetts William Francis Galvin, Secretary of the Commonwealth Public Records Division Manza Arthur Supervisor of Records January 5, 2024 SPR23/3080 Helen Rush-Lloyd Records Access Officer Department of Public Health 250 Washington Street Boston, MA 02108 Dear Ms. Rush-Lloyd: I have received the petition of William McDonagh appealing the nonresponse of the Bureau of Health Professions Licensure (Bureau) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On November 6, 2023, Mr. McDonagh requested the following records: [1] A copy of the Public Profile for [an identified] PA; [2] A copy of the Public Profile for [an identified] PA; [3] A copy of any continui[ng] training required by the above PA’s. Claiming to not yet have received responsive records, Mr. McDonagh petitioned this office and this appeal, SPR23/3080, was opened as a result. Subsequently, I learned that the Department of Public Health (Department) intends on providing a response to Mr. McDonagh on behalf of the Bureau. Accordingly, the Department is ordered to provide Mr. McDonagh with said response in accordance with the Public Records Law, its Regulations and this order within ten business days. A copy of any such response must be provided to this office. It is preferable to send an electronic copy of the response to this office at pre@sec.state.ma.us. Mr. McDonagh may appeal the substantive nature of the Department’s response within ninety days. See 950 C.M.R. 32.08(1).
