The Commonwealth of Massachusetts William Francis Galvin, Secretary of the Commonwealth Public Records Division Manza Arthur Supervisor of Records December 27, 2023 SPR23/3095 Hanne Rush, Esq. Assistant Attorney General Records Access Officer Office of the Attorney General One Ashburton Place, 20th Floor Boston, MA 02108 Dear Attorney Rush: I have received the petition of David A. Russcol, Esq., of Zalkind Duncan & Bernstein, LLP., appealing the nonresponse of the Office of the Attorney General (AGO) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On December 7, 2023, Attorney Russcol requested “[a]ll notifications pursuant to G. L. c. 271, § 49(d) of intent to enter into loan transactions received during May 2023, submitted by or on behalf of [identified individuals].” Claiming to not yet have received responsive records, Attorney Russcol petitioned this office and this appeal, SPR23/3095, was opened as a result. Subsequently, I learned that the AGO provided a response to Attorney Russcol on December 22, 2023. Where this appeal was opened as a result of the AGO’s lack of a response, I will now consider this administrative appeal closed. Attorney Russcol may appeal the substantive nature of the AGO’s response within ninety (90) days. See 950 C.M.R. 32.08(1). Sincerely, Manza Arthur Supervisor of Records cc: David A. Russcol, Esq.
