Assistant Attorney General Records Access Officer Office of the Attorney General One Ashburton Place, 20th Floor Boston, MA 02108 Dear Attorney Rush: I have received the petition of David A. Russcol, Esq., of Zalkind Duncan & Bernstein, LLP., appealing the nonresponse of the Office of the Attorney General (AGO) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On December 7, 2023, Attorney Russcol requested “[a]ll notifications pursuant to G. L. c. 271, § 49(d) of intent to enter into loan transactions received during May 2023, submitted by or on behalf of [identified individuals].” Claiming to not yet have received responsive records, Attorney Russcol petitioned this office and this appeal, SPR23/3095, was opened as a result. Subsequently, I learned that the AGO provided a response to Attorney Russcol on December 22, 2023. Where this appeal was opened as a result of the AGO’s lack of a response, I will now consider this administrative appeal closed.
