The Commonwealth of Massachusetts William Francis Galvin, Secretary of the Commonwealth Public Records Division Manza Arthur Supervisor of Records January 11, 2024 SPR23/3122 Rebecca Whitaker Public Records Officer Town of Dalton Dalton Town Hall 462 Main Street Dalton, MA 01226 Dear Ms. Whitaker: I have received the petition of Patrick Mason appealing the nonresponse of the Town of Dalton (Town) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On December 12, 2023, Mr. Mason requested the following records: [1.] ... with regards to the departments Vehicular Pursuits policy no. 104 (41.2.2) the After Action Reporting and Training as outlined in the policy for the following pursuits involving [an identified individual]: March 21, 2023 # 23-30-AR[;] April 18, 2021 # 21-29-AR[;] June 30, 2021 # 21-56-AR [2.] ... the policy under Training the dates for the past 3 years of annual training on pursuit policy and the roster of those in attendance. I have enclosed page 8 and 9 of the policy which outlines After Action Report and Training. Claiming to not yet have received responsive records, Mr. Mason petitioned this office and this appeal, SPR23/3122, was opened as a result. Subsequently, I learned that the Town provided Mr. Mason with a response dated January 3, 2024. Where this appeal was opened as a result of the Town’s lack of a written response, I will now consider this administrative appeal closed. Mr. Mason may appeal the substantive nature of the Town’s response within ninety (90) days. See 950 C.M.R. 32.08(1).
