The Commonwealth of Massachusetts William Francis Galvin, Secretary of the Commonwealth Public Records Division Manza Arthur Supervisor of Records January 18, 2024 SPR24/0012 Seah Levy Public Records Access Officer City of Cambridge 795 Massachusetts Avenue Cambridge, MA 02139 Dear Ms. Levy: I have received the petition of Heather Hoffman, Esq. appealing the response of the City of Cambridge (City) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On October 26, 2023, Attorney Hoffman requested, “…any currently effective [C]ity policy regarding how to handle public [record] requests for information that are neither submitted directly to the public records officer nor explicitly labeled public records requests.” Prior Appeal The requested records were the subject of a prior appeal. See SPR23/3036 Determination of the Supervisor of Records (January 2, 2024). The City responded on December 20, 2023. Unsatisfied with the City’s December 20, 2023 response, Attorney Hoffman petitioned this office, and this appeal, SPR24/0012, was opened as a result. Subsequently, I learned that the City provided a further response to Attorney Hoffman on January 12, 2024. Where the basis of this appeal was opened as a result of the City’s December 20th response, I will now consider this administrative appeal closed. Attorney Hoffman may appeal the substantive nature of the City’s January 12th response within ninety (90) days. See 950 C.M.R. 32.08(1).
