See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On November 27, 2023, Mr. Simard requested: …any and all communication, to include but not limited to emails, memos, voice messages, internal reports, correspondence, etc., between any agent of the City to include but not limited to [identified individuals], HR personnel and anyone representing the City of Lawrence and [an identified individual], in relation to his employment by the City. Please include all communications and correspondence, including work and private emails in relation to [an identified individual] and the P.O.S.T. Commission by any agent of the City. Claiming to not yet have received responsive records, Mr. Simard petitioned this office and this appeal, SPR24/0027, was opened as a result. Subsequently, I learned that the City intends on providing a response to Mr. Simard. Accordingly, the City is ordered to provide Mr. Simard with said response in accordance with the Public Records Law, its Regulations and this order within ten business days. A copy of any such response must be provided to this office. It is preferable to send an electronic copy of the response to this office at pre@sec.state.ma.us. Mr. Simard may appeal the substantive nature of the City’s response within ninety days. See 950 C.M.R. 32.08(1).
