The Commonwealth of Massachusetts William Francis Galvin, Secretary of the Commonwealth Public Records Division Manza Arthur Supervisor of Records January 9, 2024 SPR24/0041 Ruthy Barros Records Access Officer Massachusetts Commission Against Discrimination 1 Ashburton Place, Suite 601 Boston, MA 02108 Dear Ms. Barros: I have received the petition of Christopher Kaczmarek, Esq. appealing the response of the Massachusetts Commission Against Discrimination (Commission) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On December 22, 2023, Attorney Kaczmarek requested “[a]ny/all charge(s) of discrimination, respondent’s position statement, the investigative disposition(s) associated with, and any and all documents concerning, each such charge filed by Complainant . . . This includes, but is not limited to, any charge filed by [a named individual] against Waste Connections US, Inc. and/or MTG Disposal, LLC including, but not limited to, MCAD [specified docket number].” The Commission provided a response on December 22, 2023. Unsatisfied with the Commission’s response, Attorney Kaczmarek petitioned this office and this appeal, SPR24/0041, was opened as a result. Subsequently, I learned that the Commission provided a further response on January 8, 2024. Where this appeal was opened as a result of the Commission’s December 22, 2023 response, I will now consider this administrative appeal closed. Attorney Kaczmarek may appeal the substantive nature of the Commission’s January 8th response within ninety (90) days. See 950 C.M.R. 32.08(1).
