See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On December 8, 2023, Attorney Baillet requested the following records pertaining to [an identified officer] of the Somerville Police Department: [1.] Application materials; [2.] Complaints received by the POST Commission, including those received when POST was developing its ‘database listing complaints against police officers’; [3.] Documents regarding any independent investigation into the conduct of this officer, including the outcome and any discipline imposed; [4.] ‘Notice of Denial of Recertification’ and/or ‘Notice of Conditional Certification’; [5.] Decisions made by the POST Commission, the Executive Director, or a single commissioner regarding this officer and any information collected to make this determination; [6.] Audio recordings, transcripts, and evidence presented at any hearings held in relation to this officer; [7.] Records regarding whether their agency head or relevant supervisor refused to or declined to attest to that officer’s good moral character, regardless of the officer’s certification status, including all explanations or records that identify the basis for lack of attestation of good moral character, including non-attestation forms and officer questionnaires; [8.] Records regarding whether this officer is listed in a National Decertification Index, or did not pass a State or National Background Check; and One Ashburton Place, Room 1719, Boston, Massachusetts 02108 • (617) 727-2832• Fax: (617) 727-5914 sec.state.ma.us/pre • pre@sec.state.ma.us

Claiming to not yet have received responsive records, Attorney Baillet petitioned this office and this appeal, SPR24/0075, was opened as a result. Subsequently, I learned that the Commission provided Attorney Baillet with a response dated January 11, 2024. Where this appeal was opened as a result of the Commission’s lack of a written response, I will now consider this administrative appeal closed. Attorney Baillet may appeal the substantive nature of the Commission’s response within ninety (90) days. See 950 C.M.R. 32.08(1).
