Deputy Chief Counsel Department of Unemployment Assistance 100 Cambridge Street, Suite 400 Boston, MA 02114 Dear Attorney Cronin: I have received the petition of Andrew M. MacDonald, Esq., of Fox Rothschild LLP., on behalf of Auto Parts Xpress LLC (the “Company”), appealing the nonresponse of the Department of Unemployment Assistance (Department) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On November 21, 2023 Attorney MacDonald requested, “[a]ll public records as that term is broadly defined in the law related to the Company and the debt described in the letter.” Claiming to not yet have received responsive records, Attorney MacDonald petitioned this office and this appeal, SPR24/0078, was opened as a result. Subsequently, I learned that the Department intends on providing a response to Attorney MacDonald. Accordingly, the Department is ordered to provide Attorney MacDonald with said response in accordance with the Public Records Law, its Regulations and this order within ten business days. A copy of any such response must be provided to this office. It is preferable to send an electronic copy of the response to this office at pre@sec.state.ma.us.
