General Counsel Records Access Officer Office of Consumer Affairs and Business Regulation 501 Boylston Street Boston, MA 02116 Dear Attorney Dick: I have received the petition of Edward Kalman appealing the nonresponse of the Office of Consumer Affairs and Business Regulation (Office) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On December 7, 2023, Mr. Kalman requested the following records: 1. Public records related to complaint 2023-281 [concerning an identified individual], but not the complaint filed by me which was received by the Office on October 31, 2023[;] 2. Public records which relate to or identify if [an identified individual] is or is not registered as a home improvement contractor pursuant to Mass. Gen. Laws C. 142A. Claiming to not yet have received responsive records, Mr. Kalman petitioned this office and this appeal, SPR24/0125, was opened as a result. Subsequently, I learned that the Office provided Mr. Kalman with a response dated January 17, 2024. Where this appeal was opened as a result of the Office’s lack of a written response, I will now consider this administrative appeal closed. Mr. Kalman may appeal the substantive nature of the Office’s response within ninety (90) days. See 950 C.M.R. 32.08(1).
