The Commonwealth of Massachusetts William Francis Galvin, Secretary of the Commonwealth Public Records Division Manza Arthur Supervisor of Records January 31, 2024 SPR24/0152 Kerri Ann McManus Town Clerk Town of Georgetown 1 Library Street Georgetown, MA 01833 Dear Ms. McManus: I have received the petition of Kevin Wood appealing the response of the Town of Georgetown (Town) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On December 23, 2023, Mr. Wood requested the following: [1.] Draft meeting minutes for 12.21.23 Conservation Commission meeting. [2.] Draft meeting minutes for 11.30.23 Conservation Commission meeting open session and executive session. Previous Appeal This request was the subject of a previous appeal. See SPR23/3120 Determination of the Supervisor of Records (January 11, 2024). In my January 11th determination, I found it was unclear which exemption the Town is citing in order to withhold the requested records. Subsequently, the Town responded on January 17, 2024. Unsatisfied with the Town’s response, Mr. Wood further appealed, and this case was opened as a result. Conclusion Subsequent to the opening of this appeal, based on a telephone conversation between this office and the Town on January 19, 2024, I understand that the Town intends to provide a supplemental response to Mr. Wood. Accordingly, said response must be provided in a manner consistent with the Public Records Law and its Regulations within ten business days. It is preferable to send an electronic copy of the response to this office at pre@sec.state.ma.us. If issues remain unresolved, Mr. Wood may appeal the substantive nature of the Town’s supplemental response within ninety days. See 950 C.M.R. 32.08(1).
