General Counsel Office of the State Auditor One Ashburton Place, Room 1819 Boston, MA 02108 Dear Attorney Leung-Tat: On January 18, 2024, this office received your petition on behalf of the Office of the State Auditor (Office) seeking an extension of time to produce records. G. L. c. 66, § 10(c); G. L. c. 66, § 10(d)(iv); see also 950 C.M.R. 32.06(4). As required by law, it is my understanding that the Office furnished a copy of the petition to the requestor, Colman Herman. G. L. c. 66, § 10(c); G. L. c. 66, § 10(d)(iv)(2). On December 25, 2023, Mr. Herman requested “…copies of any and all nondisclosure agreements collected by the office of the state auditor.” Subsequently, in an email to the Office and this Division on January 18, 2024, Mr. Herman states “…[I] agree to the expansion of time to January 25, 2024…” Further, the Office responded on January 19, 2024 in part, “…Mr. Herman has assented to provide the Office of the State Auditor with an extension of time until January 25, 2024.” In light of the above, it is unnecessary to opine on the Office’s petition for an extension of time to produce records. Further, this office encourages Mr. Herman and the Office to continue to communicate to facilitate providing records more efficiently and affordably. See G. L. c. 66, § 10(b)(vii).
