The Commonwealth of Massachusetts William Francis Galvin, Secretary of the Commonwealth Public Records Division Manza Arthur Supervisor of Records February 1, 2024 SPR24/0167 Shawn A. Williams, Esq. Director of Public Records Records Access Officer City of Boston One City Hall Square Boston, MA 02201 Dear Attorney Williams: I have received the petition of the Boston Accountability Network (“requestor”) appealing the nonresponse of the City of Boston (City) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On December 14, 2023, the requestor sought the following records: All correspondence between every city of Boston agency (Mayor’s Office, Legal Department, etc.), with [an identified individual] as well as any and all individuals/organizations acting on behalf, or in the interest of, [an identified individual]. To elaborate, we are looking for all correspondence related to a suit that [an identified city officials]’s spokesman has previously confirmed was filed by the attorney(s) of [an identified individual] against [an identified city official] and the city of Boston following the vehicle collision involving [an identified city official]. Claiming to not yet have received a response, the requestor petitioned this office and this appeal, SPR24/0167, was opened as a result. Subsequently, I learned that the City intends on providing a written response to the requestor. Accordingly, the City is ordered to provide the requestor with a response in accordance with the Public Records Law, its Regulations and this order within ten business days. A copy of any such response must be provided to this office. It is preferable to send an electronic copy of the response to this office at pre@sec.state.ma.us. The requestor may appeal the substantive nature of the City’s response within ninety days. See 950 C.M.R. 32.08(1).
