Assistant General Counsel Executive Office of Public Safety and Security 1 Ashburton Place, Suite 2133 Boston, MA 02108 Dear Attorney Mullaney: I have received the petition of Karina Wilkinson appealing the nonresponse of the Executive Office of Public Safety and Security (Office) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On January 5, 2024, Ms. Wilkinson requested: [1.] ...public records under M.G.L. ch. 66, § 10 for any amendments to the Securus Technologies’ contract with the Massachusetts Department of Correction for the prison inmate calling service (ICS), since Amendment #7, signed by ... in September, 2020[;] [2.] ... documents showing DOC monthly phone and video call volumes and call minutes and the number of electronic messages sent for the period June 1, 2023 to the present. Claiming to not yet have received responsive records, Ms. Wilkinson petitioned this office and this appeal, SPR24/0194, was opened as a result. Despite being notified of the opening of this appeal, it remains unclear whether the Office has provided a response. Accordingly, the Office is ordered to provide Ms. Wilkinson with a response to her request, provided in a manner consistent with this order, the Public Records Law and its Regulations within ten (10) business days. A copy of any such response must be provided to this office. It is preferable to send an electronic copy of the response to this office at pre@sec.state.ma.us. Ms. Wilkinson may appeal the substantive nature of the Office’s response within ninety (90) days. See 950 C.M.R. 32.08(1).
