Shears Merrimac Police Department 2 Jana Way Merrimac, MA 01860 Dear Chief Shears: I have received the petition of Stephen May appealing the nonresponse of the Merrimac Police Department (Department) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On January 8, 2024, Mr. May requested records concerning an incident on January 5, 2024 at [an identified location] in Merrimac. Claiming to not yet have received responsive records, Mr. May petitioned this office and this appeal, SPR24/0208, was opened as a result. Subsequently, I learned that the Department provided Mr. May with a response dated January 24, 2024. Where this appeal was opened as a result of the Department’s lack of a written response, I will consider this administrative appeal closed. Mr. May appeal the substantive nature of the Department’s response within ninety (90) days. See 950 C.M.R. 32.08(1).
