See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On December 15, 2023, Mr. Herman requested: [1.] [A] copy of the investigative report dealing with [a named individual] [2.] [A] copy of the settlement agreement executed with [a named individual] [3.] [A] copy of the agreement executed with the law firm that investigated the [named individual] matter and the invoices submitted by the law firm.” Prior Appeals This request was the subject of prior appeals. See SPR24/0022 Determination of the Supervisor of Records (January 11, 2024) and SPR24/0111 Determination of the Supervisor of Records (January 25, 2024). In my January 25th determination, it was my understanding that the University provided a further response to Mr. Herman on January 24, 2024. Unsatisfied with the response, Mr. Herman petitioned this office and this appeal, SPR24/0216, was opened as a result. It is my understanding that the University intends on providing a further response to Mr. Herman to address his records request. Accordingly, the University is ordered to provide Mr. Herman with said response in a manner consistent with this order, the Public Records Law and its Regulations within ten (10) business days. A copy of any such response must be provided to this office. It is preferable to send an electronic copy of the response to this office at pre@sec.state.ma.us. Mr. Herman may appeal the substantive nature of the University’s response within ninety (90) days. See 950 C.M.R. 32.08(1).
