Assistant District Attorney Essex County District Attorney’s Office 10 Federal Street Salem, MA 01970 Dear Attorney O’Sullivan: I have received the petitions of Andrew Quemere, appealing the nonresponse of the Essex County District Attorney’s Office (Office) to two requests for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). SPR24/0226 On January 3, 2024, Mr. Quemere requested “[a]ll records related to the criminal case against [an identified individual], who in November 1989 was convicted of arson and 15 counts of second-degree murder related to a July 4, 1984, fire in Beverly, Massachusetts.” SPR24/0227 On December 29, 2023, Mr. Quemere requested “[a]ll transcripts related to the criminal trials of [an identified individual], who in 1989 was convicted of arson and 15 counts of second- degree murder.” Claiming to not yet have received responsive records, Mr. Quemere petitioned this office and these appeals, SPR24/0226 and SPR24/0227, were opened as a result. Despite being notified of the opening of these appeals, it remains unclear whether the Office has provided a response. Accordingly, the Office is ordered to provide Mr. Quemere with a response to the requests, provided in a manner consistent with this order, the Public Records Law and its Regulations within ten (10) business days. A copy of any such response must be provided to this office. It is preferable to send an electronic copy of the response to this office at pre@sec.state.ma.us. Mr. Quemere may appeal the substantive nature of the Office’s response within ninety (90) days. See 950 C.M.R. 32.08(1).
