Assistant District Attorney Norfolk County District Attorney’s Office 45 Shawmut Road Canton, MA 02021 Dear Attorney Hunt: I have received the petition of David Magraw appealing the nonresponse of the Norfolk County District Attorney’s Office (Office) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On December 27, 2023, Mr. Magraw stated “[w]as the interview of [identified individuals], and the report of that interview, which was available for my December 1994 trial - my December 22, 2023 letter - perhaps conducted on a different date? If yes, and you have a copy of the report of that interview, I would like to be provided a copy of that report.” Claiming to not yet have received responsive records, Mr. Magraw petitioned this office and this appeal, SPR24/0231, was opened as a result. Despite being notified of the opening of this appeal, it remains unclear whether the Office has provided a response. Accordingly, the Office is ordered to provide Mr. Magraw with a response to his request, provided in a manner consistent with this order, the Public Records Law and its Regulations within ten (10) business days. A copy of any such response must be provided to this office. It is preferable to send an electronic copy of the response to this office at pre@sec.state.ma.us. Mr. Magraw may appeal the substantive nature of the Office’s response within ninety (90) days. See 950 C.M.R. 32.08(1).
