Assistant City Solicitor Law Department City of Worcester 455 Main Street, Room 301 Worcester, MA 01608 Dear Attorney Thompson: I have received the petition of Merritt Schnipper, Esq., of Schnipper Hennessy PC, appealing the response of the City of Worcester (City) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On October 3, 2023, Attorney Schnipper requested “[r]ecords of all communications and travel by [an identified individual] between 9/1/2018 and 9/30/2018.” Prior Appeal The requested records were the subject of a prior appeal. See SPR23/2547 Determination of the Supervisor of Records (November 7, 2023). In my November 7, 2023 determination, I learned that the City intends to provide a supplemental response to Attorney Schnipper. On November 29, 2023, January 11, 2024 and January 24, 2024, the City provided responses. Unsatisfied with the responses, Attorney Schnipper petitioned this office and this appeal, SPR24/0235, was opened as a result. Subsequently, I learned that the City intends on providing a supplemental response to Attorney Schnipper. Accordingly, the City is ordered to provide Attorney Schnipper with said response to the request in accordance with the Public Records Law, its Regulations and this order within ten business days. A copy of any such response must be provided to this office. It is preferable to send an electronic copy of the response to this office at pre@sec.state.ma.us. Attorney Schnipper may appeal the substantive nature of the City’s response within ninety days. See 950 C.M.R. 32.08(1).
