Fallon: I have received the petition of Blue POV (requestor) appealing the response of the Leominster Police Department (Department) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On January 30, 2024, the requestor sought, “all bodycam footage for the arrest of [an identified individual] arrested on 06/05/2023.” The Department provided responses on January 31, 2024 and February 2, 2024. The Department provided a further supplemental explanation on February 5, 2024. Unsatisfied with the Department’s responses, the requestor petitioned this office and this appeal, SPR24/0322 was opened as a result. It is my understanding that the Department intends on providing a further response to the requestor. Accordingly, the Department is ordered to provide the requestor with said response in a manner consistent with the Public Records Law and its Regulations within 10 business days. It is preferable to send an electronic copy of the response to this office at pre@sec.state.ma.us. The requestor may appeal the substantive nature of the Department’s response within ninety days. See 950 C.M.R. 32.08(1).
